Introduction to the Whistleblower Regulation

The whistleblower directive, directive (EU) 2019/1937, was adopted by the European Parliament in October 2019. 

For companies with more than 250 employees, a whistleblower scheme must be established no later than 17 December 2021. However, companies with between 50-249 employees have until 17 December 2023 to establish a whistleblower scheme.



How do I follow the whistleblower rules?


According to the directive, it is a requirement that you as a company appoint a person or department to manage the scheme. It can be done both internally or with the help of an external third party.

Your whistleblower system must also allow information to be submitted in writing and/or verbally. In addition, as I said, the whistleblower must have the option of anonymity.

After a whistleblower has reported information, the recipient must give confirmation of receipt no later than 7 days after.
